VIJAYKUMBHAR.COM a Project Specific & Private Real Estate Discussion Forum for Affected People

Our Mission is to educate and motivate flat, plot, land buyers to take adequate precaution before and after the investment in real estate projects. Normally people do not dare and unite to ask builders uncomfortable questions or problems they face. VIJAYKUMBHAR.COM is the place where people without disclosing their identity can discuss on the projects they have invested in. Unless affected people unite they are not able to take proper step in case of any problems. This forum will be for discussion as well as for guidance from other  members and team of vijaykumbhar.com. Members of particular forum will decide on their own to take  or not any action regarding that specific project if needed.This is a subscription based forum . 


Time and again, government brings in restrictions and imposes prohibitions to protect buyers of property, be it land, plot, apartments or bungalows. Despite that, scams and scandals keep surfacing on a regular basis. Builders and project proponents of plotting schemes, find loopholes in laws and regulations, play different tricks, play with words, and give deceptive promises and so on. They run scams like selling proposed N-A Plots, Villa plots, farmhouses, affordable housing, promising to double your money by investing in plotting or plantation schemes  etc. They never fulfill promises they give to flat buyers. They appoint smart staff and agents. Most of the time, staff and agents get paid more than what they deserve and hence they don’t hesitate to deceive own relatives or acquaintances.

It is not the case that government official don’t understand or are not aware of such cases but they are hand in glove with promoters of such schemes and land mafias and so they turn a blind eye to such crimes. For buyers or small investors, it is difficult to know what is right and what is wrong. They do not understand how to move forward if there is problem with a project they have invested money in or if they have bought a flat. So what is the remedy?

One should always take ample care before investing in any scheme. Discuss it before & after investing in it. But the basic problem is buyers or small investors of such schemes are always scared and scattered. They do not dare to ask anything to builders or promoters of such schemes.

To discuss such matters we introduce VIJAYKUMBHAR.COM, a project specific private discussion forum. In this forum, members are supposed to share the information and discuss regarding that specific real estate project only. That will help, proposed or existing buyers to find out the truth, factual problems of specific real estate projects and to decide future course of action, if any.

We assure complete secrecy of member’s identity and also assure that we will not allow any building or plotting project to advertise on VIJAYKUMBHAR.COM unless we are satisfied with the credentials of that particular project.


To enable  team of VIJAYKUMBHAR.COM to guide forum, initially we will start forums on projects in Pune and Mumbai revenue area only. Temple Rose Real Estate Scam is an Organised Crime...

Temple rose real estate scam is organised crime also. There is team of 15 to 20 persons who  are involved in this entire scam. You will find their names almost  in every temple rose project as a genuine buyer . But at the same time they are involved in land deals for same or other projects with temple rose directors in all over Maharashtra. They pretend themselves as genuine plot buyers to deceive other genuine investors  only.

And that may be the reason when   temple rose real estate scam was exposed so many plot  buyers called this writer but very few turned up for the meeting held there after for any further action. This happened because genuine plot buyers are scared & scattered and   others  were just stooges of the company itself. Unless plot buyer get united, there is hardly any possibility of getting their money back or plot.


Fear of losing money already invested may be another reason that  duped  investors  don’t come forward to take action on such scammers.  One person wrote this writer after  he  read  post on Temple Rose city scam. He had  bought a plot in their Rose City PH-1, Pingori Project. He had already paid them EMIs for around 2 years and stopped paying since last 1.5yrs.When he visited their office in Pune they again convinced him but asked him to pay the remaining money after they get the NA. He eventually did nothing for 1.5 year. Now how can the plot that was not in possession of Temple Rose Real Estate (TRRE) and the plot Temple Rose Live Stock(TRLS)  has already sold can be NA? .

Another example is of rose city Phase VII .Actually Rose city phase I to VI were related to survey no 810 and phase VII was related to survey no 827.As per temple rose website there are still some plots available for sale. However they have already sold all that land . They had done same thing in case of rose city other phases.

Temple Rose have broke almost all laws , rules and regulation regarding land deals and income tax also. Off course they have done all these crimes hand with gloves of public authorities in Maharashtra. Needless to say they why such authorities would have done so. Under the Bombay Tenancy and Agricultural Lands Act, 1948, no person can purchase agricultural land in Maharashtra if he is not a farmer. As well there is ceiling on holding agriculture land by a genuine farmer and ban on dividing agriculture lands. Almost in all the land deals TRRE has executed with registration department there nothing mentioned how money for particular deed was paid or received?

Agreements with  plot purchasers are not done properly also .Actually documents for real estate have to be registered at the department of registration. Notarised sale deeds doesn’t bear any value. However notarization was also not done properly. When asked everybody denied that  notarization was done before the notary. Attesting affidavits in the absence of its executants or deponents and authenticating instruments without verifying the identity of persons coming for attestation and the fact of execution is illegal. And stamp paper that documents are notarized on has  to in the name of either of the parties to the Deed , that has also been not followed by Temple Rose.

So called Transparency is another funny part of Temple rose real estate scam. They have displayed names of the plot holder on their website. There is  “ view detail” option to check details of that certain plot. But to view that option you need to have application number. However none of the lot holder this writer came across had such application number.


In the nutshell everybody involved in  the activities of Temple Rose Real Estate Scam has played a significant role in its crime and hence it falls in the category of organised crime . Criminal activities that are planned and controlled by powerful groups and carried out on a large scale Fall in that category.

Can a black magic help land grab ?

When they couldn't deter me from saving my society's interest the idiots have started  doing such silly things. They are now taking help of black magic. They throw black dolls, kumkum ,turmeric ,lemons, chillies , coconut etc. either at my door of my flat in society in Anupama  society or in from of my building.




First, someone encroached upon my societies road  when I  complained  about it. A corporator  of Pune municipal corporation threatened me in front of municipal authorities.  

Then when it came to my knowltedge that one Mukesh Gada and Arun Ranwade who were  not even remotely connected with our society had grabbed two plots from our society with fabricated and bogus  Power of Attorney. Even registration authorities registered documents without looking into the authenticity of IT. Then I lodged the complaint with IGR. IGR subsequently lodged  a police complaint. But the sub-registrar who knowingly registered this documents is safe, nothing has been done against him.

Then revenue authorities also changed the mutation entries according to the document registered with the IGR. Actually such document is not the certificate of ownership of the property. The revenue authorities are bound to take adequate precaution while changing the mutation entries. The revenue officer has to summon earlier owner and also visit the property before changing mutation entries. But who care about the rules , when corruption comes in to the picture.

I have complained about irregularities done while changing mutation entries of my society's plot to revenue authority's in February 2016. however they have not taken cognizance of it. They might be waiting for the thing to happen again , that happened while changing mutation entries fraudulently.

Since last many months I am asking for some documents of the property adjacent to our society . Municipal  authorities are not able to provide it. Actually time being I don't have any objection about that  property, but since they are using our society's internal road I just want to know the fact. But property owner being relative of highly influential political person municipal authorities are not revealing anything. Now I have filed an RTI. let us see what happens.

Our society is very old society .I don't know why but the  residents of this society are scared of anybody who is uniform, even the postman. I have purchased a flat here some 8-10 years back. Initially I was not aware of the gravity of the  situation, however when I started to get knowledge of the facts I was shocked. Each and everybody who was connected to the society or knew about its residents behavior tried to loot it. And this is not about my society only . This is happening in all parts of pune city.

Hurdles in appointment of Real Estate Regulatory Authority in Maharashtra Removed

Any time after 1st May 2016 the government of Maharashtra may establish Real Restate Regulatory Authority ( RERA )or delegate its power to somebody. On account of present controversy over Maple Groups misleading advertisements under Pradhanmantri awas Yojana ( PMAY) , FIR’s and further drama, it was alleged that presence of RERA would have made significant difference and timely intervention of RERA would have saved several peoples’ hard earned money. However, now with notification dated 27th April 2016 hurdles in appointment of RERA or delegating it’s powers to somebody have been removed .

The Ministry of Housing and Urban Poverty Alleviation (MHUPA) of government of India has brought in to force some provisions of Real Estate ( Regulatortion nad Development )  Act 2016
( REA )   as well it has repealed The Maharashtra Housing (Regulation and Development) Act, 2012. The MHUPA has announced this with a notification dated 27 April 2016.With this notification MHUPA has brought some sections of the Real Estate Regulatory Act 2016   into force.


Section 81 read with Section 82 ( C ) Real Estate Regulatory Act empowers appropriate Government to delegate powers of RERA  to any authority  if circumstances exist which render it necessary in the public interest so to do. The MHUPA has brought in to force section 81 to 92 including following provisions of REA  from 1 may 2016.

Section 2 – Definitions, This section deals with the all the terms used in real estate sector

Section 20 to 39 – These sections deal with the Establishment and incorporation of Real Estate Regulatory Authority, Composition of Authority. Qualifications of Chairperson and Members of Authority. Term of office of Chairperson and Members. Salary and allowances payable to Chairperson and Members. Administrative powers of Chairperson. Removal of Chairperson and Members from office in certain circumstances. Restrictions on Chairperson or Members on employment after cessation of office

Section 41 to 58 – These sections deal with the Establishment of Central Advisory Council. Functions of Central Advisory Council. Establishment of Real Estate Appellate Tribunal.

Section 71 to 78 – These sections deal with Power to adjudicate. Factors to be taken into account by the adjudicating officer.

CREDAI should clarify on 1 BHK flat for rupees 5 lakh

Maple Shelters who recently offered  1 BHK flat only for rupees 5 lakh under Pradhan Mantra Awas Yojana (PMAY). But recently Maple has sold 30 square meter flats at whopping cost of around 19 lakhs . There was a lot of chaos after advertisment regarding this appeared in media. Fact is, it is almost impossible to provide 1 BHK flat in 5 Lakh rupees in or around pune . However Credai pune metro has made rival argument supporting Maple shelters.Hence the responsibility to clarify on , how come these flats worth around 19 lakhs rupees will be made available in just 5 lakh rupees is on credai only

No doubt Credai has full right to support its members. But the way it presented its stand on claims made by Maple shelters that may not be acceptable to all. Because aims of credai are to perpetuate self-imposed and mandatory for all the member an ethical code of conduct. But it seems that credai has devited from it.

Credai has claimed that , it is possible for a developer to deliver homes at  a cost of Rs. 7.2 lakhs as advertised by the Maple shelters. Credai also confirmed that at the cost of Rs. 2200 psf, in the fringe areas where land costs are low, homes are possible to be constructed and delivered. With the subsidy of Rs. 2.2 lakhs under the PMAY CLSS scheme, it is very possible to deliver homes to the affordable segment at a cost of Rs. 5 lakhs as envisaged by the Government.

Now let us have a look at two sale deeds registered in March 2016. Both sale deed are of same maple shelters who is claiming to provide 1 BHK flat in just 5  lakhs. One is of what they call moshi annex of Kharabwadi and other is of Nanekarwadi.

At kharabwadi they have  sold a flat of area 29.17 square metres ( exactly the carpet area equivalent to scheme under PMAY) at rupees 18,38,942 /- ( Rupees eighteen lakh thirty eight thousand nine hudred and fourty two ) that comes to around 6,129 rupees per square foot. Even as per ready reckoner rate comes to around 4,350/-



Other is at Nanekarwadi , they have sold 32.24 sq.mt flat at cost of 19,58,165 ( nineteen lakh fifty eight thousand one hundred and sixty five ) , that comes  to around Rs  6116/-( six thousand one hundred and nineteen rupees) even as per ready reckoner this rate comes to Rs 4687/- ( four thousand six hundred and eight seven rupees)




Now its up to Credai to clarify that how come these around 30 sq.mt flats can be sold at the cost of 5 lakh rupees. Even after subsidy under PMAY schemes the rates of these flats come to around 16, 18,942 and 17,38,165 respectively. Even as per ready reckoner rates come to 14 lakh and 15 lakh respectively.

Smart cities to be secret cities, beginning of the end of transparency era

Finally, skeletons of real intentions behind smart cities mission have been started tumbling out of the cupboard. Initially making governance citizen-friendly was the key objective of smart cities projects, and public participation was said to be core tool to achieve it. Now instead of transparency, the secrecy has become the buzzword for smart cities mission. The Government of India has issued a model Article of Association (AoA)  for the company to be formed under special purpose vehicle ( SPV) for smart cities, that keeps entire functioning of smart city projects behind closed doors.

There are several clauses that are controversial in this AoA, but secrecy clause has become the matter of concern for transparency activists in India. The smart city mission had already killed basic principles of the 74th amendment to the constitution of India that was brought to strengthen urban local bodies. Now with this secrecy clause, it has taken the soul out of Right to information act.

The preamble of RTI act says “Democracy requires an informed citizenry and transparency of information which are vital to its functioning and also to contain corruption and to hold Governments and their instrumentalities accountable to the governed;”. The smart city mission stands exactly opposite, it says ‘nobody has right to demand and nobody has  a right disclose any information with respect to the company formed under SPV.

(i) Every Director, Manager, Secretary, Auditor, Treasurer, Trustee, member of a committee, officer, servant, agent, accountant or any other person employed in the business of the Company shall, if so required by the Directors, before entering upon his duties, sign a declaration pledging himself to observe strict secrecy respecting all transactions and affairs of the Company with the customers and the state of the accounts with individuals and in matters relating thereto, and shall by such declaration pledge himself not to reveal any of the matters which may come to his knowledge in the discharge of his duties except when required so to do by the Directors or by law or by the person to whom such matters relate and except so far as may be necessary in order to comply with any of the provisions in these presents contained.

(ii) No member shall be entitled to visit or inspect any works of the Company without the permission of the Directors or to require discovery of or any information respecting any details of the Company's trading, or any matter which is or may be in the nature of a trade secret, mystery of trade, secret process or any other matter which may relate to the conduct of the business of the Company and which in the opinion of the Directors, it would be inexpedient in the interest of the Company to disclose. We, the several persons whose names and addresses are subscribed are desirous of being formed into a company in pursuance of these Articles, and we respectively agree to take the number of shares in the Capital of the Company set opposite our respective names.

In short smart city mission gives all the rights to collect taxes, user charges, sell, lease public properties, take loans, earn profit for the share holders ,to the company formed under SPV and confiscates all the rights conferred upon common citizens by constitution of India

Since the Right to Information act 2005 (RTI) was introduced 10 years back, bureaucracy and politicians made several attempts to kill or dilute its provisions. Several attempts were made to sabotage it. However despite various attacks RTI has made a very small but positive impact on governance. Irrespective of the quantity of impact it has shaken wrongdoers inside out. It seems hence they have introduced “mission smart cities.

As far as Smart City Pune project is concerned there is complete Lack of Transparency in the entire process. The Agreement signed between PMC & Mckinsey has been uploaded belatedly on the PMC website. PMC has resorted to a limited transparency policy by not fully uploading documents pertaining to the award of the contract to Mckinsey. Appendix B – Key experts and Appendix C – Breakdown of the contract price, which is an integral part of the Agreement have not been uploaded. The letters of invitation to the consultants along with the Annexure are not uploaded on the PMC website. Details of the selection process are completely absent. These documents are critical to the award of the contract on which the RFP for the Smart City is based.

Interestingly when asked about whether the amendments given to Pune Smart city project by councilors of Pune Municipal Corporation (  PMC ) will be accepted or not,  Union Urban Development Minister Venkaiah Naidu refusing the chances they would have to strictly adhere to the guidelines laid down under the Smart City Mission and that if they refuse to toe the line, they will have to opt out of the project. On the contrary, event though there are   serious violations of the Model Request for Proposal (RFP) and the irregular concessions granted to Mckinsey against the public interest, the central government is silent on it.

The would be Chief executive officer of proposed SPV   and presently municipal commissioner PMC has already encroached upon a general body and standing committee’s rights.Though he has not revealed any of PMC’s correspondence with whom it has signed so-called nonfinancial nonbinding Memorandum of understanding (MoU) , he has gone further to assure reimbursement of the amount to an institute without knowledge of a general body and standing committee’s. It seems that he has assured reimbursement as CEO of proposed SPV.


In a letter to principal director of symbiosis Kunal Kumar writes

“I welcome our collaboration wherein MBA—IM students from SCMHRD, Symbiosis would work with us as interns for Smart Cities Mission. This is a path-breaking partnership which brings together academia with Government in mission mode in finding solutions for real life issues faced by the city.

Further, with reference to your email regarding budget proposal based on 60 days of engagement, we convey our agreement with the same. We would, however like you to undertake the expenditure up front and thereafter let us reimburse the amount to you.

We  believe  this  engagement  will  go  a  long  way  in  enabling  the transformation  of  Pune  city under Smart Cities Mission.”

Interestingly SCMHRD’s name doesn’t appear in the list of PMC’s so-called nonbinding nonfinancial MoU’s it has signed. No one knows how many such agreements he has signed on behalf of PMC.However as far as nonbinding nonfinancial MoU’s that PMC has signed are concerned. The commissioner has categorically said that they will be allowed to participate in the tendering process of SPV and there lies the threat of manipulating proposed so-called transparent tendering process.

Builders can’t sell common areas & amenities, Bombay HC

The Bombay High Court  (HC) recently clarified that the Promoter/developer has no right to sell any portion of the building which is not a flat  and the entire land and the building has to be conveyed to the society.The only right which remains with the promoter is to sell unsold flats .HC further observed that selling of common amenities like the basements, cellars, yards, gardens, parking areas and storage spaces is contrary to the development agreement and the provisions of development control regulations.

In pune and surrounding area sale, lease and commercial use of common amenities by builders’ promoters is common phenomenon, be it cooperative housing society, township, Special Township or any other complex. These people sale or lease common amenities or charge fees to the members for the amenities that are meant free for them. The recent judgement is setback to such activities.

Council for petitioner in this case submitted that those construction which were without consumption of any FSI were forming part of the common amenities and belong to the petitioner no.1 society for the benefit of its members and no interest of any nature whatsoever could be claimed by the respondent developer  in respect of such common amenities and thus no third party rights in respect thereof can be created by the respondent developer .

In support of this submission, counsel placed reliance on the judgment of Supreme Court incase of Nahalchand Laloochand Private Limited vs. Panchali Cooperative Housing Society Limited (2010) 9 SCC 536 and in particular paragraphs 54 to 65 and submitted that the promoter has no right to sell any portion of the building which is not a flat and the entire land and building has to be conveyed to the petitioner. The only right which remains with the respondent no.1 is to sell the unsold flats and has no right to sell any stilt parking spaces or any area forming part of common amenities exclusive parking area allotted to the respondent developer under the said development agreement.

The Bombay high court through its order restrained a city builder from selling the common areas of a newly constructed building, Anand Villa, on Linking Road, Santacruz , Mumbai.In this case respondent developer  had created mortgage in respect of some part of the common amenities illegally along with three commercial shops. HC also restrained the respondent developer , their servants, agents and/or representatives and/or any other claiming by, from, through or under them are restrained by an order of injunction of this court from in any manner transferring, encumbering, alienating, or creating any third party right

Beware ! NGT Fines Mumbai Builder, Be Prepared to Lose Property & Money

The National Green Tribunal (NGT) has fined Mumbai builder for violation of Environment norms. NGT has also asked Project Proponent to not to create third party interest until he amends the plan and deposits the fine. This and earlier same judgments will have long lasting impact on real estate industry. Especially Pune being hub of illegal real estate projects. Recent judgments on violation of environment norms show that courts are not ready to pardon environment violation on account of fait accompli. And that is the reason project proponents and property buyers need to worry and take precaution.

There are so many real estate projects that have started or completed without obtaining necessary environment clearance (EC) . Even in some cases builders have forcefully given possession to flat purchasers. Everybody who are about to book, booked or have taken possession in such project need to be cautious because in that case even after taking possession if NGT or court asks to amend plan, property buyers  may have  to wash their hands of said property.

In this case project was started without obtaining EC and there after EC was given but SEAC turned a blind eye to the construction carried out in violation of environment norms. NGT didn’t cancel said EC but asked project proponent to amend the plan of the sale building, get it approved as per law and asked him not to proceed and not to create third party interest by way of sale, transfer, assignment, lease or parting with possession of any portion of sale building/component in any manner whatsoever shall be made unless the amounts as directed  are paid and necessary amends to comply with the directions to provide additional parking spaces are made.

In pune and around more than 150 projects have started construction without obtaining EC and there are some projects to whom EC has been denied. However in these both the cases either project proponent has forcefully given possession or some have willingly taken possession. If we look at recent judgments on violation of environment norms it seems that courts are not ready to pardon environment violation on account of fait accompli. And that is the reason project proponents and property buyers need to worry and take precaution.

NGT also observed that the project proponent violated the EC Regulations, 2006 by undertaking construction before the EC was granted and thereby denied the realistic environmental safeguard to be in place. NGT also said that it may not be possible to determine compensation on account of violations of EC Regulations with consequential untold damage to the environment and with some exactitude, but that should not be the reason for the project proponent to avoid their liability in that regard. The NGT has already held that   non-compliance of environment norms would be of serious consequence, not only on environment but upon the society at large.

And hence NGT has asked project Proponent priyali builders  to  pay and remit a sum of Rs. 3 crores to the Authority, specified under sub-section (3) of section 7(A) of the Public Liability Insurance Act, 1991 ( PLI Act )  to be credited to the Environmental Relief Fund within a fortnight. PLI Act is an An act to provide for public liability- insurance for the purpose of providing immediate relief to the persons affected by accident occurring while handling any hazardous substance and for matters connected therewith or incidental thereto. In this case collector is an authority to recover such fines. NGT has asked this sum to credited in the Environmental Relief Fund within a fortnight.

NGT also asked respondent priyali builders  pay an amount of Rs. 32,63,600/- being market price of the deficient recreational area as on March, 2014 to the Maharashtra Pollution Control Board for incurring expenses on Environmental and ecological rehabilitation within a fortnight.

Recent NGT judgments are eye opener for builders violating environment norms and also for the property buyers who ignore such things, ignorance of law can not can be excuse to pardon to wrong doings. Builders cheat when property buyers become emotional fool. Now its up to property buyers to decide next course of action. Actually stopping such illegal activities is responsibility of concerned authorities and officials but when they become party to such cheating, property buyers need to take this responsibility on own shoulders.

How to find approved real estate project in Pune and Pimpri Chinchwad area?

There are several projects going on in and around pune area .As this area has become hub of illegal real estate activities, buyers are confused about how many of them are really approved. Actually all such information must be provided by concerned public authorities proactively.

As well only approval from concerned authorities does not make such projects really legal. There are several other factors such as even after approval from building permission authorities projects above two lakh square feet need environmental clearance before commencing work or some times builders don’t follow the the rules, regulation and guidelines while work is on and get notices for violations and even they  continue with work and selling flats.

Irregularities or illegalities after obtaining necessary commencement certificate are another thing but at least buyers should know status of primary approval. As far as Pimpri chinchawad Municipal Corporation is concerned one can search approved projects easily here. PCMC has also made applying for RTI online , Hence if buyers have any query regarding any project then they can file  RTI application from their home .


And as far as pune municipal corporation (PMC) is concerned it is very difficult to know about approved projects. Yes they have made facility to get such information online, but it doesn’t work. If you try this facility software just keeps processing your request but nothing happens further. Hence I have procured and reproduced below list of projects approved by PMC in recent past. These projects are above 20000 sq.ft projects and are approved within last two-three years. For projects below 20000 sq ft one has to contact ward office of PMC.
